Studio Policies

Shine Fitness Studio is committed to the health, safety, and welfare of each of its visitors and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. To advance these purposes, Shine Fitness Studio has policies governing conduct of studio visitors. These policies are subject to change at any time with or without notice.

Code of Conduct

It is important that all our visitors feel welcome and safe at Shine Fitness Studio. Any conduct unbecoming, such as disrespectful communication, not adhering to the policies of the studio, foul language, inappropriate behavior, or negative conduct of any kind is not acceptable in the Shine Fitness Studio culture. 

By visiting Shine Fitness Studio, visitor agrees to abide by these policies and to respect the decisions made in the absolute discretion of Shine Fitness Studio regarding any disputes or violations. If visitor does not observe Shine Fitness Studio’s policies, Shine Fitness Studio reserves the right to take disciplinary action including without limitation requiring visitor to leave the studio premises and immediate termination of membership or passes without refund. 

If you have a concern, please ask for a meeting with studio management to discuss in private.

LIABILITY WAIVERS

Please note that all participants in Shine Fitness Studio classes must have a signed waiver.

The waiver can be completed:
  • In your Momence account (Parents or guardian, can fill out a waiver for your child at registration, under your child's account)
  • When you arrive a the studio for the first time.

AGE REQUIREMENTS

Shine Fitness Studio's Youth Program is currently composed of group classes, private lessons, and summer camps for ages 7 (or 2nd grade) to 14 (or 8th grade). Youth students 12+ are also eligible for Open Studio on a by-approval basis.

Students who are aged 15 and older may attend adult classes. We recommend that students who are transitioning from the youth program to the adult program work with their current instructor to assess maturity level and fit for adult classes.

Students must be 18 years of age to attend pole fitness classes.

Defined ages - Tots (2-3, 4-6), youth (7 or 2nd grade - 14 or 8th grade), adult aerials (15+), pole fitness (18+)

EARLY CANCELLATIONS FOR CLASS REGISTRATION

You may cancel 12 hours before class start time with no penalty. Your pass will be added back to your account to be used before the pass expiration date. For example:

  • If your class starts at 7:30 pm, you will need to cancel your reservation by 7:30 am
  • If your class starts at 12:30 pm, you will need to cancel your reservation by 12:30 am.

The class roster will lock and not accept any more registrations for that particular class 30 minutes prior to class start time. Those on the wait list will be notified of any open spots 2 hours before class start time. If you are added to the class and do not show up to class, the system will enforce the no-show fee. If you are added to the class and cancel during the late cancellation window, you will be charged a late fee and lose your pass.

If you are unable to make a class that you are waitlisted for, remove your name so the person next in line has a chance to take the class.

If you are unable to sign up for a class due to locking times, please message the studio or call at 817.756.1313 to book.

LATE CANCELLATION & NO SHOW FEES

Failure to cancel your class 12 hours prior to class start time OR not showing up for class will result in a loss in a pass for pass holders plus a $15 fee or a $15 fee for unlimited memberships. Fees will be charged to your card on file the day after your late cancellation/no show.

We understand life happens, message the studio or call to let us know what is going on. We will accommodate you within reason.

Late Arrivals

We understand delays happen, but your safety and understanding of Shine Fitness Studio and classes is critical.

First timers - Please arrive 10 minutes early to receive a tour and introduction to the studio and the classes and communicate any preexisting injuries.

Student who arrive 10+ minutes after class start time will not be admitted to class. The late cancel/no show policy will be enforced for students not admitted to class. Proper warm-up is a REQUIREMENT for every class to prevent possible injuries.

No refunds issued for denied entry. 

STUDIO CANCELLATIONS/WEATHER CLOSINGS

Shine Fitness Studio reserves the right to cancel a class up to 2 hours prior to start time. Shine Fitness Studio follows the Birdville ISD for weather related closings. For weather related closings, we will notify participants through email and text about class cancellation. 

Adult Classes: Your pass will be added back to your account and no fees will be charged for cancellations on behalf of Shine Fitness Studio.

Youth Classes: Rescheduling of classes due to weather closing is at the discretion of the studio.

Mastery of Skills

Unsupervised practice by students is strictly prohibited. Proper mastery of basic skills is required prior to progressing to more advanced skills that require more strength, control, height, and endurance, regardless of the level of current fitness or previous training.

New skills must be practiced and successfully executed at ground level with instructor approval before attempting them aerially. Students are strictly prohibited from attempting anything without proper instruction. Test outs may be required to move to the next level. Check with your instructor for more information.

This includes anything seen on social media, in another Shine Fitness Studio class, or at another aerial/pole studio. If you are interested in learning the skill, please notify an instructor. The instructor may evaluate the skill, determine the level of difficulty, and prepare to break it down for proper basic instruction as deemed appropriate.

PHOTOS & VIDEOS

Approval must be obtained from instructors prior to any videotaping. Students may record themselves in classes for personal use only. Students acknowledge and agree that Shine Fitness Studio classes and curriculum are the exclusive property of Shine Fitness Studio and are protected by intellectual property laws. Students shall not use, reproduce, distribute, display, or sell any recordings of Shine Fitness Studio classes for any commercial purpose. Students shall also not use any recordings of Shine Fitness Studio classes to create derivative works. Student understands and agrees that any violation of this clause may result in legal action by Shine Fitness Studio and dismissal from the studio and/or termination of membership without refund.

Arriving & Leaving the studio

We recommend all students arrive 10-15 minutes before the first class, camp day, drop-in class, or private to fill out paperwork. After that, we suggest that students plan to arrive 5-10 minutes before the start of class.

Location of Drop Off & Pick Up
8535 Airport Freeway, Ste 200, North Richland Hills, TX 76180 - Shine Fitness Studio is located in the shopping center with Spectrum, near the At Home store. Our building has a blue awning and is an off white color. Our entrance is at the top of the wide staircase with two sets of double doors. Please drop off and pick up your child in the lobby area near the front desk. 

Students that arrive more than 10 minutes late to any class are welcome to stay and watch, but they will not be allowed to participate. It is dangerous to engage in any aerial-related activities without a proper warm-up.

We recommend that parents and guardians arrive before your child’s class ends for pick-up. Shine Fitness Studio is not in a position to properly supervise a child after class is dismissed. Youth will stay with their teacher and at 5 minutes after class has ended will be escorted to the Front Desk. For excessive late pickups (after 2 instances without communication), there could be an additional charge. If you’re running late, please call us at 817.756.1313.

For their safety, students should wear street clothes and shoes when entering and leaving Shine Fitness Studio.

OBSERVATION FOR CLASSES

We do not allow non-participating guests (such as the parents of youth students or people providing rides to our students) to wait in our lobby area while our students take group classes. We often encourage these guests to take advantage of the other services near the studio–in order to save space in the studio during busy times and help keep students focused on their work.

SICK POLICY

Due to the physical nature of aerial activities, participants experiencing COVID/Flu-like symptoms (fever, actively coughing, sneezing, running nose) will be asked to leave to avoid transferring germs to other participants and the apparatuses.

It is up to the discretion of all Shine Fitness Studio staff members to prohibit any student from participating in any activity for the safety of the student, instructor and/or other students.

No make-ups, credits, or refunds will be provided for any days missed.

Student-Instructor Interaction

Please be advised that aerial practice involves physical contact. Instructors will often need to make hands-on contact to adjust students’ form and to demonstrate proper motion.

Students and parents should keep instructors informed of any recent illness, injury, or other condition that may interfere with their aerial practice.

Spotting - Instructors will always ask students for consent before spotting them physically. If the student does not grant consent, the instructor will visually spot the student and provide verbal guidance.

Mandatory reporting

Shine Fitness Studio has a zero tolerance for violence and abuse. Shine Fitness Studio will report to the appropriate authorities any situation in which we have reasonable cause to believe a student is suffering from physical, emotional, or sexual abuse or neglect.

All Shine Fitness Studio staff undergo the Texas Department of Family and Protective Services online tutorial on mandated reporting in the State of Texas.

RULE OF THREE

For our youth participants: When teachers are working one-on-one with students, such as in a private lesson or in a solo class, we require that parents or guardians remain for the duration of the lesson in the same room as the student and instructor. Youth are never alone with an adult in any room with a closed door. 

Studio Video Cameras

All rooms in Shine Fitness Studio (except the bathroom) are monitored by cameras. All adult classes, youth classes, drop-ins, camps, private lessons, and parties are video recorded for our staff, teacher, and student safety and for liability reasons as stated in our insurance policy. These recordings of activities are stored for a period of 30 days. Any recordings related to incidents are stored for a period of 1 year.

FIRST AID, CPR, AED CERTIFICTIONS

All Shine team members are First Aid, CPR, and AED certified for child and adult through the American Heart Association. Our team undergoes recertification every two years to stay up to date with the latest techniques and safety protocols.

BATHROOM BREAKS

There are no designated bathroom breaks for youth programs. We strongly recommend that students use the bathroom before class begins to ensure uninterrupted class time. 

Instructors and staff are not permitted to accompany students into the bathroom or assist them in using the bathroom. 

Damages

Remove all jewelry, watches, etc., from your hands, wrists, ankles, and feet. Check for zippers on clothing and change if needed.

Visitors shall be liable for any damages to Shine Fitness Studio property that result from the intentional, grossly negligent, or negligent conduct of visitor, visitor's guest, or visitor's children.

EQUIPMENT

Safety equipment is REQUIRED:
  • Pole Fitness: Participants must use crash mats for any new inverted moves until cleared by the instructor.
  • Aerial Apparatuses: MUST USE FLOOR MATS AT ALL TIMES. NO EXCEPTIONS. Additional mats should be used based on the level of difficulty, age of student and risk.

Students are prohibited from assisting with equipment set-up or tear down for their own safety and liability. Equipment should be used as intended and cared for properly. Equipment damage by students may result in replacement fees as determined by Shine Fitness Studio. 

Bring Your Own Apparatus
Shine Fitness Studio students and visitors may bring their own aerial apparatuses to use in the studio upon completing our approval process. Individuals who wish to bring their own equipment to the studio for training (classes, open studios, private lessons, showcases, etc.) must receive prior approval from Shine Fitness Studio and agree to abide by the studio’s Personal Equipment Policies and Guidelines.

Alcohol and Drug Consumption

Alcohol and Drug consumption is strictly prohibited. Students and private party participants must not be under the influence of drugs or alcohol while training or participating in any activities. This includes prescription or over-the-counter medications that might alter the ability to focus or concentrate.

No refunds issued for students or party participants asked not to participate.

Open Studio

No instruction is provided during open studio. Use this time to practice skills you’ve learned in class, freestyle, or fine-tune a routine. Students are strictly prohibited from attempting anything without proper instruction. This includes anything seen on social media, in another Shine Fitness Studio class, or at another aerial/pole studio.

Mats must be used at ALL times for aerials. Pole mats should be used when working on aerial skills that have not been mastered. No heels on mats.

PRIVATE LESSONS

Private and semi-private lessons are available for all participants. During private lessons, the focus will be on building foundational skills to prepare the student for entering a class. We do not teach skills that are above the student’s level.

Youth under the age of 6 may take Private Lessons at Shine Fitness Studio with the additional supervision by their parent(s) or guardian(s). 

You may cancel or reschedule your private lesson up to 12 hours prior to your private lesson start time. No refunds are given for private lessons. Failure to cancel your private lesson will result in a loss in the private lesson.

Private Parties

You may reschedule your celebration for up to 14 days in advance with no penalty. Celebrations rescheduled less than 14 days in advance may incur a $50 rescheduling fee. Celebrations canceled 30 days prior to the event will receive a full refund less a $50 cancellation fee. Celebrations canceled less than 30 days prior to the event will receive a partial refund of 50% less the $50 cancellation fee. Celebrations canceled less than 24 hours prior to the event will not receive a refund. 

Workshops & Private Events

Workshops and private events cannot be canceled. Workshops and Private events are non-refundable but may be transferred. Passes and private lessons expire 1 year after the purchased date.

Apparel & Product Returns

Unworn apparel and unused products may be returned for credit or exchanges. We do not offer refunds for apparel or products.

Introductory Offers & Promotions

No refunds or extensions for unused services or products. Please consider and review the terms before purchasing. Please see introductory offer and promotion for full details.

Buddy passes

Buddy Passes can be used to attend Level 1 Pole, Level 1 Hoop, Level 1 Fabric, Flexibility, Conditioning, or Pilates classes. A studio visitor may only receive one buddy pass per month.

Memberships

We have highlighted FAQs and key terms from our Membership Agreement. Full terms of the Shine Fitness Studio Membership Agreement can be found in your Momence Account or can be requested via email at frontdesk@shinefitnessstudio.com.

Term Lengths
  • Initial Term: The initial term of this Agreement is either three (3), six (6), or twelve (12) months, as provided in Membership Summary (“Initial Term”). If no Initial Term is selected in Membership Summary, the Initial Term shall be three (3) months. 
  • Automatic Renewal. Thereafter, the initial term the membership is automatically renewed for each a Renewal Term of one month, unless this membership is terminated.


Membership Freeze
Member may freeze their membership for any reason for one (1) calendar month within one (1) year of the Effective Date of this Agreement. A suspension fee of $50 will apply for each such freeze request. Member may also freeze their membership at no additional charge due to injury, FMLA, or active duty military service, for the duration of such condition.

Shine Fitness Studio reserves the right to request documentation of the relevant condition that is satisfactory to Shine Fitness Studio in its absolute discretion, including without limitation a signed note from Member’s physician or military orders.

Additional freezes are prohibited.

Member must notify Shine Fitness Studio of their intention to freeze their membership in writing by email to frontdesk@shinefitnessstudio.com at least seven (7) business days before the desired freeze start date. The email must specify both the freeze start date and the reactivation date. Freeze requests that are not made with sufficient notice may not be honored. Member will not be charged additional membership fees during the freeze period. Billing will resume automatically upon the end of the freeze period.

Membership Agreement Termination
Member may terminate Membership Agreement effective as of the expiration of the current Initial Term or Renewal Term, provided that Member must give written notice of termination to Shine Fitness Studio at least thirty (30) days prior to the expiration of the current Initial Term or Renewal Term.  Termination notice may be emailed to frontdesk@shinefitnessstudio.com. If Member fails to give timely written notice, this Agreement shall renew for another full Renewal Term and Member may not terminate it until the expiration of such Renewal Term. 

Early Termination
Member may terminate this Agreement at any time during the Initial term with Member’s payment of 50% of the remaining balance of membership fees owed under this Agreement as liquidated damages. The parties agree that the damages caused by Member’s early termination of this Agreement would be impossible or difficult to accurately estimate at the time of the Agreement, and that the agreed upon amount is a reasonable estimate of Shine Fitness Studio's lost revenue, administrative costs, and costs associated with underutilized resources. The liquidated damages are not intended as a penalty but are intended to compensate Shine Fitness Studio for the financial loss incurred due to Member’s early termination of the contract. Shine Fitness Studio may terminate this Agreement at its sole discretion at any time, provided that Shine Fitness Studio shall give a prorated refund to Member as of the termination date. Member shall no longer be entitled to attend classes upon early termination.

Automatic Termination
The Membership Agreement shall be canceled upon receipt of written notice in the event of the death or disability of Member (provided that Member also presents a note signed by their physician regarding the nature of the disability and Member’s inability to participate in Shine Fitness Studio classes.)

Termination Due to Change of Residence
Member may cancel Membership Agreement upon written notice that Member has changed her residence to a location more than thirty (30) miles from a Shine Fitness Studio. The member must provide proof of new residence with the written notice of cancellation.

Promotions
Promotional pricing will not be valid after the termination of the Membership agreement.

Modifications

Shine Fitness Studio, LLC reserves the right to modify the Member Agreement with notice to Member by email or letter to the address on file. Such modifications and additional terms and conditions will be effective upon the next Renewal Term. Your acceptance of a Renewal Term will be deemed acceptance thereof.
